How Will I Pay My Legal Fees?
The funding of legal fees can also be a contentious issue between the parties. Often one party can pay, the other cannot. Parties often ask how will I pay my legal fees. If a party cannot meet their legal fees, and the other party will not assist them, they will have to enquire about other sources of funding, including the availability of a litigation loan.
Can my spouse pay my legal costs?
If they are unable to obtain funding, it may be open to that party to apply to the court for an order that the other party pays their legal fees at a set amount. This is known as a legal services order. Before this application can be made, evidence must be provided to the court that there is no other funding available. An application for a legal services order should be considered as a final resort.
Can I pay my legal fees at the end of the case?
A party can, in certain circumstances, agree a deferred fee arrangement with their solicitor whereby payment is made at the conclusion of the proceedings.
